« Real Time » host Bill Maher vowed that he wouldn’t « pre-hate » the incoming Trump administration despite his own personal animosity towards President-elect Donald Trump. « They are calling themselves the ‘disruptors,' » Maher began during a panel discussion Friday night. « The country does need disrupting. I mean, the country needs a colonic and a slap in the face so bad. »This is not who I would choose to administer the colonic but it’s not like the bureaucracy isn’t bloated. It’s not like the debt isn’t $36 trillion. it’s not like there aren’t thousands of regulations that do stop people from living lives that they could live better and don’t do anything. There is woke in the military. Whatever they’re going after… I’m not going to pre-hate anything, » Maher said. « Do I have really good, optimistic feelings about it? No, I don’t. I’m just not gonna pre-hate. I can’t get into that mind[set]. Let’s see what the disruptors can do. Texas AG sues Dallas for decriminalizing marijuana

Texas Attorney General Ken Paxton announced a lawsuit Thursday targeting the blue city of Dallas over a ballot measure that decriminalizes marijuana.Paxton alleges that Proposition R, which « prohibits the Dallas Police Department from making arrests or issuing citations for marijuana possession or considering the odor of marijuana as probable cause for search or seizure, » violates state law.The attorney general argues in the lawsuit that the ballot measure is preempted by Texas law, which criminalizes the possession and distribution of marijuana. He told Fox News Digital he wanted to give himself a challenge and race in a series outside his comfort zone. »There’s so many options that would have been a lot easier and maybe more of a natural fit, » he said. « I really wanted to challenge myself and do something different. « It’s probably the decision I’m most happy about because it led me down a path of exploration and learning different ways to drive a vehicle. And I fell in love with that aspect of motor racing – away from being good at driving one type of car one way. I fell in love with, ‘Oh, this car, I need to, as a driver, do a lot of different things to optimize the vehicle.’ And I fell in love with that. »With Rallycross after stock car racing, it was another evolution of that like, ‘OK, this requires something else,’ and I’ve just been always in love and fascinated with what it takes to try to maximize the physics of the vehicles. I’ve been lucky to have those opportunities to be able to go from all these different disciplines. »Speed also offered advice to young drivers looking to break into the sport. »Don’t quit, » he said. « I really believe you can have everything you want in life if you want it bad enough. It always comes down to being willing to pay the price that it costs and if you’re willing to put in the energy and time that it needs to do something. Anything’s possible. »I think that the most important thing is you love what you do. I was very lucky to find at a very young age that I loved racing, and I was able to pursue that and turn that into a career. But I think the love of racing is the bedrock of that because the effort and energy it takes to be successful in something as difficult as motor racing requires a lot of energy. 24 states’ attorneys general call on Supreme Court to keep biological boys out of girls sports

Attorneys general from 24 states are urging the U.S. Supreme Court to overturn a lower court ruling and uphold an Arizona law to prohibit biological boys from competing on girls’ sports teams.The petition comes after a federal appeals court ruled that the law likely violates the Equal Protection Clause of the Constitution. »Sports teams are divided by sex to begin with to give girls a level playing field so they’re not competing against boys, » South Carolina Attorney General Alan Wilson said in a news release. « Arizona’s law restricting girls’ sports teams to biological females is just common sense, and it protects girls from competing against bigger, stronger males who identify as females. »FEDERAL JUDGE PUSHES BACK ON PARENTS CALLING TRANS ATHLETE ‘A BOY’ IN LEGAL BATTLE OVER PRO-GIRLS PROTESTSIn addition to Wilson, the attorneys general supporting the petition are those from Alabama, Alaska, Arkansas, Florida, Georgia, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Oklahoma, South Dakota, Tennessee, Texas, Utah, Virginia and Wyoming.The petition notes that these states have laws similar to Arizona’s that restrict girls’ sports to biological females.It also argues that the Equal Protection Clause does not prohibit states from offering separate sports teams for men, women, boys and girls.GIRLS CATHOLIC SCHOOL VOLLEYBALL TEAM COULD FACE PENALTY AFTER FANS BOO TRANS ATHLETE ON PUBLIC SCHOOL TEAM »In sports, equal access means a level playing field, » the attorneys general write in their brief. « And a level playing field usually means sports teams divided by sex so that girls can compete against other girls. » »Basing the distinction on biology rather than gender identity makes sense because it is the differences in biology—not gender identity—that call for separate teams in the first place: Whatever their gender identity, biological males are, on average, stronger and faster than biological females. If those average physical differences did not matter, there would be no need to segregate sports teams at all, » they continued.The attorneys general are asking the high court to « make it clear that the Constitution does not prohibit states from saving women’s sports from unfair competition and providing meaningful athletic opportunities for girls and women, » according to Wilson’s news release.

Soros-backed prosecutor under fire over death penalty decision for Laken Riley’s killer

When a Georgia judge convicted Jose Ibarra, Laken Riley’s killer, on 10 counts and sentenced him to life in prison without the possibility of parole, politicians and pundits across the country expressed frustration that he was not sentenced to death.Over a nearly four-day trial, prosecutor Sheila Ross brought 29 witnesses to the stand to prove that Ibarra brutally attacked and killed Riley, a 22-year-old Augusta University nursing student who was jogging on the University of Georgia campus by bashing her head with large rocks and possibly strangling her.But Georgia Western Judicial Circuit District Attorney Deborah Gonzalez decided not to pursue the death penalty against Ibarra in May, about three months after Riley’s murder, saying in a May 31 press release that the decision to seek life without the possibility of parole instead of death was « reached after careful deliberation with the senior prosecutor and the support of the victim’s family. » »Our utmost duty is to ensure that justice is served and that the victim’s family is an integral part of the deliberation process, » Gonzalez said in a statement at the time. « We understand that there will be those outside this office who will disagree with our decision and seek to exploit this case for political gain. Sadly, prosecutor Deborah Gonzalez failed Laken Hope Riley in death by not seeking the death penalty against Jose Ibarra. If there was ever a case that called for the death penalty, it was this case. »Republican Georgia State Rep. It is cruel & in humane, » Gonzalez said in a Sept. 23, 2020, post on X. « As DA of #athensga I will not seek it in any prosecution. The eye for an eye argument does not make our community whole. Restorative justice does that. »On her first day in office, Gonzalez’s office outlined some of her new initiatives, which included not seeking the death penalty, in a memo her office sent to the Georgia state legislature at the time. Gaines shared parts of the memo on X in February after Riley’s murder, urging the DA to pursue the death penalty.In that memo, Gonzalez said she would « take into account collateral consequences to undocumented defendants, » or, in other words, the negative impacts of criminal convictions for illegal immigrants. »District Attorney Gonzalez is wrong for factoring into her decision not to seek the death penalty ‘collateral consequences to undocumented defendants,' » Williams said. « It is outrageous to believe that any DA sworn to uphold the law looking at the facts of this case would take into consideration how undocumented defendants are to be treated in the criminal justice system. A decision to seek the death penalty should be based solely on the individual merits of a case and not whether a person is undocumented. »Gonazlez, who lost re-election in 2024, decided not to prosecute the Ibarra case and handed it to special prosecutor Ross, who scored a hasty conviction after the nearly four-day trial.Gonzalez received criticism from Gov. Brian Kemp and other local politicians for her failure to get a single conviction in a jury trial for a criminal case over the course of her term, WSBT-TV first reported in February.LAKEN RILEY’S ALLEGED KILLER JOSE IBARRA FLEW FROM ‘GROUND ZERO’ OF MIGRANT CRISIS TO GEORGIA »She made the decision before the case even happened, » Gaines said of Gonzalez’s anti-death penalty stance. « When you come into office and you make blanket policy statements, that’s the issue. … Again, you have individuals who come into our community like Jose Ibarra because … we’re a community that has welcomed individuals who are in this country illegally and who commit serious crimes. And they know that violent criminals are more likely to get off easy in Athens than in other places. »Gaines also noted that Gonzalez « only has a couple of lawyers left in the office because they’ve had 35 resignations for 17 positions over the last couple of years. » »They’ve had an over 200% turnover, » the state representative said. « So, she really has no lawyers left in her office, and they weren’t able to handle this case. »Gonzalez’s office did not respond to a request for comment.Ibarra illegally crossed into the United States through El Paso, Texas, in September 2022 and was released into the U.S. via parole, ICE and DHS sources previously told Fox News. He briefly lived in New York City, where he was arrested in 2023 for endangering a child. He and his 29-year-old brother, Diego Ibarra, were also previously cited for shoplifting in Athens. Jose, Diego and their younger brother, Agenis, lived in an apartment building less than a half mile from the on-campus park where Riley was running the morning of Feb. 22. Their apartment complex backed up to a shortcut that leads to running trails along UGA’s campus where Riley was found dead in a wooded area, partially naked and covered in leaves, that afternoon. She died of blunt force trauma and asphyxiation, according to a Georgia Bureau of Investigation medical examiner.Diego, who worked briefly at a UGA cafeteria before his arrest in February, had ties to a known Venezuelan gang in the U.S., Tren de Aragua, according to federal court documents.

Texas lawmaker proposes bill to abolish death penalty in Lone Star State: ‘I think sentiment is changing’

A Texas state lawmaker has introduced legislation to eliminate the death penalty in the state amid a high-profile death row case currently unfolding.Democrat state Rep. John Bucy III filed the bill for the upcoming legislative session. »I think I’ve been opposed to the death penalty my whole life as I’ve thought about its use, and should it exist in our society, » Bucy said, according to Fox 7. »Financially, if you just want to look at it economically, we spend more money to execute than to keep someone in prison, so it’s really a lose-lose situation with a high risk stake if we get it wrong, » he continued.TEXAS DEATH ROW INMATE’S LAWYER SAYS ‘THERE WAS NO CRIME’ AS SHE MAKES LAST-DITCH EFFORT TO SAVE HIS LIFEThis comes after the Texas Supreme Court cleared the way last week for the state to schedule a new execution date for inmate Robert Roberson, whose initial execution was delayed last month.Roberson is currently on death row over his conviction in which prosecutors say he killed his two-year-old daughter, Nikki Curtis, by shaking her to death, known as shaken baby syndrome. But his lawyers say Nikki actually died from other health issues such as pneumonia and that new evidence proves his innocence. His lawyers also said doctors had failed to rule out these other medical explanations for the child’s symptoms.Roberson was scheduled to be put to death on Oct. 17 before the state Supreme Court issued a stay to delay his execution shortly before it was set to take place. If he is put to death, he would be the first person in the U.S. to be executed in a case based on shaken baby syndrome.More than 80 Texas state lawmakers, as well as the detective who helped the prosecution, medical experts, parental rights groups, human rights groups, bestselling novelist John Grisham and other advocates have called for the state to grant Roberson clemency over the belief that he is innocent. A group of state lawmakers have also visited Roberson in prison to encourage him. »I feel like I’ve gotten more engaged with this Robert Roberson case and wanted to make sure that we’re continuing this conversation about the lack of humanity tied to the death penalty, » Bucy said.Texas has executed nearly 600 people since 1982, according to Texas Coalition to Abolish The Death Penalty executive director Kristin Houle Cuellar. »Which is far more than any other state in the nation, » Houle Cuellar told Fox 7. « We have quite a reputation when it comes to the use of the death penalty in Texas. »Houle Cuellar said that there have been fewer death sentences in the state in the last decade, which she partially attributes to the introduction in 2005 of life without parole. »Prosecutors have used that discretion in opting not to seek the death penalty, » Houle Cuellar said. « Even in about 30 percent of the cases that they’ve taken to trial where they’ve sought the death penalty, jurors have rejected it. »Houle Cuellar said that Harris, Dallas, Tarrant and Bexar counties lead the state in death sentences and more than half of all Texas counties have never issued a death sentence.Since 2007, multiple Texas lawmakers have unsuccessfully sought to abolish the death penalty. But Bucy says there is now enough momentum regarding the issue to reintroduce legislation to eliminate the practice.TEXAS JUDGE GRANTS INJUNCTION AHEAD OF MAN’S EXECUTION IN ‘SHAKEN BABY SYNDROME’ CASE »While it’s an uphill battle to end the death penalty in Texas, we’ve seen the number of executions go down, » he said. « I think sentiment is changing, and I also think as we see these specific cases come to life, and we start learning the specific stories, people are going to get more and more concerned about the possibility of getting it wrong. »State Sen. Sarah Eckhardt and state Rep. Joe Moody, both Democrats, have filed similar bills to abolish the death penalty, which will need to be voted on by fellow lawmakers when the legislative session begins early next year.In another Texas death row case, a judge found last month that Melissa Lucio was innocent in the 2007 death of her two-year-old daughter, Mariah. Senior State District Judge Arturo Nelson recommended that Lucio’s conviction and death sentence be overturned. The judge also found that prosecutors suppressed evidence and testimony, including statements from Lucio’s other children, that could support the claim that she was not abusive and that Mariah’s death was accidental from falling down the stairs.

Federal judge pushes back on parents calling trans athlete ‘a boy’ in legal battle over pro-girls protests

New Hampshire Judge Steven McAuliffe presided over a case involving parents in the state who wore pro-girl armbands at a high school girls soccer game that included a transgender athlete. During the case, McAuliffe pushed back on the parents for repeatedly referring to the athlete as a boy. « You seem to go out of your way to suggest there’s no such thing as a trans girl, » McAuliffe said during the hearing. McAuliffe’s federal judicial service dates back to 1992, when he was appointed by former President George H.W. Bush. On Thursday, McAuliffe heard arguments in a case in which plaintiffs Kyle Fellers and Anthony Foote sued the Bow School District after being banned from school grounds for wearing the wristbands at their daughters’ soccer game in September. THE PRONOUN POLICE HAVE ARRIVED AND ARE COMING FOR YOU NEXT The wristbands said « XX » in reference to the natural female chromosomes. The « XX » logo has become an unspoken symbol of the ongoing legal and political battle against transgender inclusion in girls and women’s sports across the country. Many consider it a women’s rights phenomenon. The no-trespass orders have since expired, but McAuliffe is deciding whether the plaintiffs should be allowed to wear the wristbands and carry signs at upcoming school events, including basketball games, swim meets and a music concert, while the case proceeds.They wore the wristbands because another federal judge in New Hampshire, Landya McCafferty, who was appointed to her seat by President Obama in 2013, ruled two transgender athletes would be allowed to play on high school girls soccer teams, overruling a state law in place to prevent that from happening. Fifteen-year-old Parker Tirrell, a transgender athlete, was allowed to compete for Plymouth Regional High School. In a lawsuit filed by Fellers and Foote, they alleged they were told by school officials to remove the armbands or they would have to leave the game. TRANS VOLLEYBALL PLAYER LEGAL HEARING OPENED WITH LONG AND HEATED DEBATE OVER WHAT PRONOUNS TO USEBoth of the fathers say the intention of the armband was not to protest Tirrell, but to support their own daughters in a game that featured a biological male. McAuliffe questioned the notion that the wristbands were in support of their own daughters. »Sometimes the message you think you’re sending might not be the message that is being sent, » he said.McAuliffe asked Foote whether it occurred to him that a transgender person might interpret the pink XX wristbands as an attempt to invalidate their existence. »If he’s a trans female, pink might be a color he likes, » Foote responded.Transgender inclusion in girls’ and women’s sports emerged as a mainstream political issue in the last few years. Instances of athletes discovered to be male and then legally protected to continue playing have emerged in rapid succession since the start of the Biden administration. This includes instances like those involving Tirrell in New Hampshire and others in Virginia and California. At the college level, a situation at San Jose State University involving a transgender volleyball player has prompted multiple lawsuits and a media firestorm. It became a talking point of Donald Trump’s presidential campaign before his recent election win. Trump and even his wife, Melania, who has admitted to disagreeing with Republicans on issues of LGBT rights, each announced they are opposed to letting biological males compete in girls and women’s sports. Trump advocated for a blanket ban during a Fox News town hall event on the campaign trail. Multiple states filed lawsuits and enacted their own laws to address the issue after the Biden-Harris administration issued a sweeping rule that clarified that Title IX’s ban on « sex » discrimination in schools covers discrimination based on gender identity, sexual orientation and « pregnancy or related conditions, » in April. The administration insisted the regulation does not address athletic eligibility. However, multiple experts presented evidence to Fox News Digital in June that it would ultimately put more biological men in women’s sports. The Supreme Court then voted 5-4 in August to reject an emergency request by the Biden administration to enforce portions of that new rule after more than two dozen Republican attorneys general sued to block the Title IX changes in their own states.During the most recent election cycle, multiple Democrats, including Texas Rep. Collin Allred backtracked on past support for transgender inclusion in women’s sports. That trend continued after the election when Massachusetts Democratic Rep. Brazilian illegal immigrant wanted for drug trafficking arrested in Massachusetts sanctuary city

A Brazilian citizen living in the United States illegally, and wanted in his home country for drug trafficking, was arrested by federal authorities in a Massachusetts sanctuary city near Boston.The unidentified suspect was taken into custody on Tuesday by U.S. Immigration and Customs Enforcement (ICE) in Somerville, which will be voting next week on a resolution to reaffirm its sanctuary status and would even provide taxpayer-funded legal services to illegal immigrants, while its police department commits to not cooperating with ICE in the detention of illegal migrants.The Brazilian crossed into the U.S. through El Paso, Texas, in 2022 and was released into the country despite facing charges back home for drug trafficking. ‘SANCTUARY’ CITY MAYOR VOWS SHE WILL DEFY TRUMP’S MASS DEPORTATION PUSH: ‘CAUSING WIDESPREAD FEAR’ »This noncitizen is accused of serious crimes in Brazil, » said ERO Boston acting Field Office Director Patricia H. Justice Department halts DEA’s random searches of airport travelers after report finds ‘serious concerns’

The Drug Enforcement Administration is no longer allowed to randomly search travelers at airports and other transit hubs after a scathing report from the Justice Department found « serious concerns » with the practice.DEA agents failed to properly document searches, may have illegally targeted minorities and, in at least one case, paid an airline employee tens of thousands of dollars over several years to suggest targets for searches, according to the report released Thursday by Justice Department Inspector General Michael Horowitz.The deputy attorney general ordered the DEA to suspend the random searches Nov. 12 after seeing a draft of the memo.AFTER POLICE SEIZED MARINE VET’S LIFE SAVINGS, RULING BRINGS HIM CLOSER TO SAVING OTHERS FROM CIVIL FORFEITUREThe report refers to video of one traveler’s experience, which went viral in July when released by the Institute for Justice, a nonprofit civil rights law firm. »I don’t consent to search, sir, » the traveler, identified as David C., tells a federal agent who is demanding to search his backpack. »You don’t have to consent, » the agent responds in the video, recorded earlier this year. When David repeats that he doesn’t consent, the other man says, « I don’t care what [about] your consent stuff. »David kept filming as the agent took his backpack off the plane and waited for a drug-detection dog. The agent claimed the dog alerted him to the bag. David continued refusing to allow the search, but eventually gave in. The agent didn’t find anything illegal in the backpack, but by the time the whole ordeal was over, David had missed his flight to New York.David was singled out because he had purchased a last-minute ticket, the agent said in the video. »We wouldn’t do this, and be doing it across the country if it wasn’t legal, » the agent can be heard saying toward the end of the recording. « It would be shut down. »The subsequent investigation found that the DEA had been paying at least one airline employee a percentage of seized cash for several years in exchange for information about passengers who purchased tickets to certain cities within 48 hours of travel.That airline employee received tens of thousands of dollars in kickbacks from the DEA over the years, the OIG found.It’s likely impossible to say how many travelers have been subjected to such searches, because the OIG report notes that the DEA rarely leaves a paper trail unless the search results in a seizure or arrest. »[The] OIG report confirms what we’ve been saying for years about predatory DEA practices at airports, » IJ Senior Attorney Dan Alban said in a statement.A 2016 USA Today investigation found that DEA agents at 15 major airports seized more than $209 million from at least 5,200 travelers over the decade prior. Most of that money was shared with local police departments, the report found.Fox News Digital previously spoke to musician Brian Moore, who had $8,500 seized while waiting at his gate at the Hartsfield-Jackson Atlanta International Airport. Moore was never charged with a crime and got his money back after a yearlong legal battle that cost him $15,000 — nearly double the amount the DEA took. »It was terrible, the worst experience of my life, » Moore said. « They basically, in that one day, in those few minutes, ruined my entire music career. »THIS COUPLE LOST THEIR HOME AFTER POLICE SEIZED THEIR CASH. A JURY AWARDED THEM $1 MILLIONIJ is currently suing the DEA and TSA over their airport seizure and forfeiture practices, and advocates for legislation that would end the « profit incentive that fuels unconstitutional searches. » »We welcome DOJ’s suspension of this program as a first step, but policy directives can be changed at any time, under this or future administrations, » Alban continued.The Justice Department memo suspends « all consensual encounters at mass transportation facilities unless they are either connected to an existing investigation or approved by the DEA Administrator based on exigent circumstances. » »The DEA’s failure to collect data for each consensual encounter, as required by its own policy, and its continued inability to provide us with any assessment of the success of these interdiction efforts once again raise questions about whether these transportation interdiction activities are an effective use of law enforcement resources—and leaves the DEA once again unable to provide adequate answers to those questions, » Horowitz wrote.The report advises the DEA to rethink whether solely purchasing a last-minute plane ticket suggests criminal activity, and if agents’ practice of approaching passengers as they are trying to board a « soon-to-be departing flight could be viewed as placing undue pressure on travelers to accede to such requests. »The DEA did not immediately respond to a request for comment on the report.The OIG noted that DEA agents are not required to wear body cameras, making David C’s recording an « important record of the interaction. »David was one of five passengers flagged for search that day, according to the report, although the delay he caused by initially refusing to let the agent search his bag meant agents were not able to contact all the other travelers.None of the travelers had a « relevant criminal history » or other reason to suggest they « might be engaged in illegal activity, » the report notes.

Venezuelan migrant arrested in Colorado for allegedly sexually assaulting boss’ 14-year-old daughter: report

A Venezuelan migrant is accused of sexually assaulting the 14-year-old daughter of his employer in Colorado while living in the basement of his home, police and reports say. Jesus Alberto Pereira Castillo had crossed into the U.S. illegally in El Paso, Texas in September 2023 before being released by the Border Patrol, Homeland Security sources told the New York Post. He was taken into custody in Denver on Tuesday. « On August 29, 2024, at about 11:00 p.m., deputies responded to a south Jefferson County residence on a sexual assault investigation. Castillo’s employer owns the residence, and Castillo was temporarily staying in the basement of the home, » the Jefferson County Sheriff’s Office said.  « At around 10:30 that evening, Castillo forced himself on the 14-year-old daughter of the homeowner, sexually assaulting her. He left the residence before deputies arrived, » it added. COLORADO DENTIST’S MURDER TRIAL PUT ON HOLD AFTER DEFENSE ‘SUDDENLY QUIT’ PRIOR TO JURY SELECTION The Sheriff’s Office says Castillo was arrested « without incident » following « many weeks of relentless investigative work. » He was expected to make his first court appearance Wednesday.COLORADO MAKES $350M ‘DEFUND POLICE’ COMEBACK AFTER RECORD HOMICIDES, VIOLENT GANG TAKEOVERS Sources also told the New York Post that Castillo previously was arrested in May this year for allegedly possessing tools for forgery/counterfeiting and larceny. They added that following the alleged sexual assault, U.S. Immigration and Customs Enforcement (ICE) had placed a detainer on Castillo. Homeland Security and the Jefferson County Sheriff’s Office did not immediately respond Friday to requests for comment from Fox News Digital.
