Una inspección de Trabajo ha certificado que los 17 becarios mexicanos del musical Malinche dirigido por Nacho Cano estaban en regla y no tenían por qué estar incluidos en el sistema de Seguridad Social ya que realizaban una formación «no reglada». Así se desgrana en el informe remitido al Juzgado de Instrucción número 19 de Madrid, al que ha tenido acceso Europa Press, en el marco de la investigación a Nacho Cano por la presunta comisión de delitos contra los derechos de los ciudadanos extranjeros y delitos contra los derechos de los trabajadores. En él se señala que «no existen evidencias que indiquen que las prácticas desarrolladas por los becarios en la referida empresa impliquen una relación laboral encubierta», recoge el texto citando el artículo 1.1 del Estatuto de los trabajadores. En la misma línea, el documento reitera que estos alumnos «realizan una formación no reglada» y, por tanto, «no incluida en el sistema educativo, por lo que no es necesaria la inclusión de los becarios en el sistema de Seguridad Social». La inspección se realizó «sin previo aviso» a la empresa y a petición de la Policía Nacional. Los agentes y la funcionaria de Trabajo irrumpieron en la Parroquia San Juan de la Cruz de Madrid, donde se encontraban diversas personas recibiendo clases de canto, interpretación, flamenco y entrenamiento personal. Durante un largo periodo de tiempo, la inspectora recabó documentación sobre las condiciones de empleo de los becarios y se entrevistó con ellos. Tras conocerse la apertura de diligencias, el pasado 9 de julio el compositor compareció ante los medios y manifestó que su paso por comisaría se debía a su «apoyo» a la presidenta de la Comunidad de Madrid, Isabel Díaz Ayuso , calificando la actuación de «persecución política» y señalando directamente al Ejecutivo de Sánchez.
